Description of Service: 

Talon Growth is an Atlanta-based digital agency that specializes in creating high-quality websites, Google Review Automation, AI Virtual Receptionists, and other AI-integrated automation tools designed to increase online visibility and scale revenue for businesses of all sizes. Talon Growth’s digital packages include creating, hosting, and maintaining selected services.

Carrier Liability:

Wireless carriers are not liable for delayed or undelivered messages.

Eligibility:

By using our SMS services, you represent that you are at least 18 years old or have the legal authority to enter into agreements on behalf of a business.

Payment Terms: 

All payments unless otherwise specified are managed by Stripe. Services are billed monthly on the original purchase date. By completing payment, the client authorizes Talon Growth to charge the selected payment method for the agreed subscription price.

Cancellation Policy: 

Clients may cancel their subscription at any time. Cancellation will stop future billing but does not retroactively refund prior charges.

Refund Policy: 

Except as expressly provided herein, all payments are non-refundable. Refunds may be issued at the discretion of Talon Growth in cases of service errors or duplicate charges.

Third-Party Services Disclaimer:

Talon Growth relies on third-party providers, including but not limited to hosting providers, domain registrars, telecommunications providers, AI providers, payment processors, and software platforms. Talon Growth is not responsible for interruptions, outages, errors, data loss, delays, or other failures caused by such third-party services.

Limitation of Liability: 

To the maximum extent permitted by law, Talon Growth shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, data loss, or business interruption. Services are provided "as-is" without guarantees of business results. Talon Growth's total liability arising out of or relating to the services shall not exceed the amount paid by the client to Talon Growth during the three months preceding the event giving rise to the claim.

Client Responsibilities: 

Clients are responsible for providing accurate business information, contact details, and review request permissions.

Compliance: 

Clients are solely responsible for ensuring that their use of Talon Growth services complies with relevant laws and the policies and guidelines of any third-party platforms used, including but not limited to Google, review platforms, and messaging services. Talon Growth provides software and automation tools but does not control how clients use those tools. Talon Growth is not responsible for any penalties, account suspensions, or policy violations resulting from a client’s use of the service.

Governing Laws:

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles.

Service Availability: 

While Talon Growth strives to maintain reliable service, uninterrupted availability is not guaranteed. Temporary service interruptions may occur due to maintenance, third-party platform issues, or technical factors beyond Talon Growth’s control.

Ownership of Content:

Clients retain ownership of content, logos, trademarks, and materials they provide to Talon Growth. Upon full payment of applicable fees, clients receive ownership of website content and deliverables specifically created for them by Talon Growth, excluding third-party software, templates, tools, and licensed components.

Modification of Services or Terms: 

Talon Growth reserves the right to modify or update its services, pricing, or Terms of Service at any time. Continued use of the service after such changes constitutes acceptance of the updated terms.

Right to Terminate: 

Talon Growth reserves the right to suspend, discontinue, refuse, or terminate services at its sole discretion, for any reason including but not limited to operational, legal, or business considerations. Clients are not entitled to continued service if Talon Growth discontinues operations. Upon termination, access to hosted services, automations, websites, and related systems may be suspended or discontinued.
